Corfu Concierge Terms and Conditions
Please read these terms and conditions carefully before using our service.
I. INTERPRETATIONS
The following terms and conditions form the basis of a contract between Corfu Concierge (SELLER) and yourself (USER) for any type of services offered by the seller.
It defines the conditions under which Corfu Concierge makes available to its members a set of services within the framework of individual subscriptions or not, that they can use while navigating on the website.
II. DEFINITIONS
The following terms shall have the following meanings:
SELLER: Corfu Concierge as a legal entity.
USER: The party or person signing any agreement with Corfu Concierge (including personal representatives, successors or permitted assigns).
CONTRACT: Agreement between the two parties (seller and user) which determine the different types of services the seller is committed to provide.
MEMBERSHIP: Agreement between the two parties (seller and user) which determine the different types of services the seller is committed to provide the User within certain parameters and time frame of subscription.
SUPPLIER/SUPPLIERS: Means a supplier introduced by Corfu Concierge to a USER to provide goods and/or services to that USER.
SERVICE / SERVICES: Means the concierge and lifestyle management services provided by Corfu Concierge to its users as part of their contract.
III. AGREEMENT ON TERMS AND CONDITIONS
Read carefully terms and conditions before using website or/and services offered by the seller
User must be of sound mind, an adult and be legally capable of contracting or subscribing to the services offered by the seller
Seller has the right to modify, adjust or change those terms and conditions at any given time without prior notice or specific requirement. Therefore, it is up to the user to regularly consult our terms and conditions section
By navigating on the website and/or by using the seller’s services, the user acknowledges those terms and conditions, agrees, accepts them and is committed to respect them
Any registration, request or order placed, directly or indirectly, by telephone, mail, internet, or SMS, to the concierge services operated by Corfu Concierge implies the unreserved acceptance of these terms and conditions that prevail over all other conditions, except them expressly accepted by Corfu Concierge
Users will be put in contact with service providers. It is up to them to consult their general conditions of use and to accept them expressly. For any service an estimate will be submitted to the member for acceptance
IV. ACCESS TO SERVICES
a. General information & responsibilities
This general information applies to all types of customers the Seller might have
Seller shall supply the services required by user during the period of the agreed contract, provided the seller shall not be required to provide or facilitate the supply of goods and /or services it (at its sole discretion) believes may violate applicable laws, standards and/or regulations or may offend taste and decency in the relevant jurisdiction
User acknowledges the Seller acts according to the requests as expressed by user. The seller cannot be held responsible for any error the user may have made, in any way, at the origin of any expressed queries. Seller shall have no liability to user for any loss, damage, costs, expenses or other claims for compensation arising from requests or instructions supplied by user which are incomplete, incorrect, inaccurate or any other fault of user
Seller accepts no liability to user or is deemed to be in breach of these terms and conditions by reason of any delay in performing, or any failure to perform any of supplier’s obligations in relation to its services, if the delay or failure was due to causes beyond seller’s reasonable control
Seller undertakes to respond to queries formulated by the user, whatever they may be, within reasonable time and undertakes to provide him with advice in relation to them
Seller cannot be held responsible for its recommendations regarding the choice of a provider
Seller cannot be held responsible for the non-performance of its obligations in case of force majeure as defined by the civil code and the courts
Given Corfu Concierge’s status as an intermediary, Seller does not assume any responsibility for the performance or otherwise by the service providers and /or supplier partners of the services or products ordered by the User. In case of a claim of any nature whatsoever, the user shall directly address the concerned providers. Seller acts as an intermediary and is responsible for representing the member to providers and/or suppliers
Seller has the right to make any changes to the services which are necessary to comply with any applicable law or safety requirement. Seller should notify user in any such event
User acknowledges that the seller reserves the right to accept commissions upon the supply of products or performance of services by any supplier
By the nature of its activity, Corfu concierge is bound by an obligation of means and not of results
Seller reserves the right to withdraw any of these services and/or refuse to supply the services requested. If seller is unable to deal with any request, it will inform user as soon as reasonably practicable
Once User’s contract is determined and approved from both seller and user, user can only make requests via telephone or email. If a request is directly made to a representative of seller, it has to be confirmed with an email or text message
b. Services for individuals
The individual concierge services provided by Corfu Concierge applies to an individual person and his/her Spouse. User is responsible for ensuring no one (other than personal representatives, successors or permitted assigns) uses its membership
The benefit of an order placed with Corfu Concierge is reserved for the USER and cannot be transferred to a third party without prior agreement, expressed in writing from Corfu Concierge, and as applicable, the agreement of the supplier / service provider
All membership/contract applications are subject to acceptance by seller at its sole discretion. Seller must notify user if membership/contract’s application has been accepted. Seller is under no duty to disclose its reason for rejecting any contract application
Correct personal details are mandatory when user applies to any of the seller’s services, including memberships. User must notify seller in case of any changes of contact details that might occurs whilst committed to one membership with seller
c. Services for Hospitality Businesses
Corfu Concierge can offer packages to different types of business entities who would like to provide their guests with concierge services:
Property owners
Travel agencies
Estate agencies
Other concierge agencies
Any hospitality businesses in need of Concierge service solutions
Seller shall design an appropriate package depending on the User needs
The package duration can vary depending on the request, from one day to one year (with renewal option to be discussed 3 months before package’s end). Requested duration will be mentioned on the offer sent by Seller. The presented offer will be valid for 30 days after the issuing date
In case of an agreement between Property owners and Seller, the package will have to specify the name of the properties covered by Corfu Concierge
Package Users can enjoy Corfu Concierge services only for the agreed period and only for guests staying in one of the agreed properties
Depending on the chosen package and the duration of it, Services will be billed to the User directly by Corfu Concierge. The validation by the user of the proposal transmitted by Corfu concierge in response to its request implies the agreement and respect of our payment policy.
d. Requests
User should always contact their dedicated contact in the first instance to manage all requests
Seller, acting reasonably, reserves the right to refuse acceptance of any requests at its sole discretion
If Seller is unable or not obliged to deal with any requests, it will inform the user as soon as reasonably practicable
If a request for a specific product or service is not available, seller may offer a substitute product or service of a similar description and standard. User may, at its own discretion, refuse acceptance of such substitute product and/or service and request a full refund in the event that payment has already been made to the supplier for the unavailable product or service
When user uses the restaurant booking service, Seller has the right to request access to credit card details of User for any deposit requested by the restaurant which is forfeited as a result of user’s cancellation of the booking
Seller reserves the right to deny restaurant requests from user if user repeatedly fails to honor their bookings or continuously violates cancellation policies
Admission of users to any clubs or bar premises is at all times at the sole discretion of the club/bar supplier and seller has no liability where a user is refused admission to a club
V. PAYMENT POLICY
Contract, agreement or membership fees shall be confirmed to user prior to acceptance of user’s application
Daily Package (from 1 to 6 days consecutives or separate) – Full payment upfront
Weekly Package (7 consecutives days with a maximum of 12 inconsecutive weeks):
1 week to 10 weeks (separated) Full payment up front
Over 10 weeks (separated)
First 10 weeks to be paid upfront
From the 11th week – remaining payment to be effective before the start of the 11th week, for a contract going on up to 20 weeks
Month package (30 consecutive days) – Full payment up front from 1 to 3 months packages. For a package including more that 3 months, Corfu Concierge has the right to settle the payment policy depending on the final agreed duration of the package. Latest payment date will be notified by Corfu Concierge on the agreement between the 2 parties. Month package can be agreed for a maximum of 10 months. Over 10 months, user must use the Year Package
Year Package (more than 10 months, consecutive or not) – 50% of final fees to be paid up front with the remainder to be paid midway through the agreed term. Payment date will be notified by Corfu Concierge on the agreement between the 2 parties
Upon enrollment, user agrees to pay the service upon receipt of the invoice. In case of late payment, Corfu Concierge cannot be held responsible for the evolution of availability and prices of products and/or services ordered
In the event of late payment, penalties may be applied either by Seller at a rate of 2% of the remaining balance, or by supplier concerned on the basis of his own general conditions of use
In some cases, the Seller may make payment for the orders of its members. The latter agrees to refund Corfu Concierge the amount of the order paid by Corfu Concierge. The payment will be made according to the general conditions of us of the supplier. The settlement can be done under different conditions, subject to prior information to the member
User acknowledges that payment of membership fees constitutes user express request for seller to provide user with services
Seller reserve the right to refuse to provide services should any payment due under above conditions not be received
VI. PACKAGE CANCELLATIONS
Seller reserves the absolute right to cancel or suspend your contract where it has reason to do so. If sellers cancel the user’s contract where it is reasonable to do so, Seller shall refund the balance of the contract on a pro-rata basis in respect of the unexpired period to which the contract fee relates.
VII. PROTECTION OF THE BRAND AND RIGHTS OF CORFU CONCIERGE
The brand Corfu Concierge, as well as all figurative marks or not and more generally all the other brands, illustrations, images and logo that are used in the relations with the user, whether they are registered or not, are and will remain the exclusive property of Corfu Concierge.
